Article 1 (Purpose and Status)

These Terms set out the detailed conditions governing the use of "Airy API" (the "Service"), provided by Out of Set Inc. (the "Company") through Airy.

These Terms are Service-Specific Terms under the Airy Terms of Service (the "General Terms") and apply together with the General Terms. Where these Terms and the General Terms conflict, these Terms shall prevail with respect to matters concerning the Service.

Article 2 (Definitions)

1. Input: Text, reference audio, or other material a User transmits to the Service via the API.
2. Output: Synthesized audio or other results generated by the Service.
3. API Key: Authentication credentials issued by the Company to a User to access the Service.
4. Preset Voice: A pre-produced synthesized voice made available by the Company through the Service.
5. Credits: The unit of usage deducted upon use of the Service, consisting of:
   • Promotional Credits: Credits granted upon registration or otherwise separately granted by the Company.
   • Included Credits: Credits granted to subscribers of a paid plan at each billing cycle.
   • Additional Credits: Credits separately purchased by a User.
6. Merchant of Record: Paddle.com Market Ltd. and its affiliates (collectively, "Paddle"), which act as the merchant of record on the Company's behalf with respect to Service fees, handling payment processing, tax matters, and invoicing.

Other terms used herein shall have the meanings set out in the General Terms.

Article 3 (Description of the Service)

1. The Company provides voice generation via API, a developer console, and usage/credit history features.
2. Beta features and models may change in accuracy or availability without prior notice, and the composition of available models may be changed or discontinued at the Company's discretion.
3. Output may differ from expectations in pronunciation or intonation; Users should review Output themselves before using it for important purposes.
4. Where the Company offers a custom voice (voice cloning) feature, Users must disclose that Output is AI-generated where there is a risk that it could be mistaken for the statement of an actual person.

Article 4 (Eligibility and API Key Management)

1. The Service is available to anyone seeking to use the API, including businesses and developers. However, individual Users must be at least 18 years of age. This is a Service-specific exception to the age requirement (14 years of age) set out in Article 4 of the General Terms, and these Terms shall prevail.
2. The Company may verify a User's age through identity verification, adult verification, or similar procedures where necessary, and may restrict use where a User is found not to meet the age requirement.
3. Users must manage their issued API Keys with the care of a good administrator and may not transfer, lend, or expose them to third parties. Any action taken using an API Key is deemed the act of the User.
