Article 1 (Purpose and Status)
This Refund Policy sets out the refund criteria applicable to Credit top-ups for the "Airy Talk" service (the "Service"), and applies together with the Airy General Terms of Service and the "Airy Talk - Terms of Service."
Article 2 (Payment and Refund Processing Entity)
Payment for Service fees is processed through Paddle, the Merchant of Record, and refunds are also generally processed through Paddle. Users may request a refund by contacting customer service ([email protected]); the Company will determine whether the request qualifies for a refund under this Policy and, if so, will proceed with the refund through Paddle.
Article 3 (Refund Principles for Credits)
- Promotional Credits granted upon registration, through events, friend referrals, or otherwise are not items of sale and are therefore not eligible for refund; unused amounts are automatically forfeited upon expiration of their validity period.
- Purchased Credits are a one-time purchase. Any bonus Credits included with a payment also form part of that purchase. Because Purchased Credits are granted to, and immediately available in, the User's account upon purchase, they are, as a general rule, not refundable except as set out in Paragraph 3 and Article 5.
- Notwithstanding the foregoing, if a User has not used any of the Credits granted by a given purchase within 14 days of the date of that purchase, the Company will refund the payment amount for that purchase upon the User's request. In such case, the Credits granted by that purchase (including any bonus Credits) are immediately forfeited.
- Whether Credits from a given purchase are unused under Paragraph 3 is determined on a per-purchase basis. Where multiple Credits exist in an account, Credits are deducted in the following order: (1) Promotional Credits, then (2) Purchased Credits. Within the same category, Credits with the earlier expiration date are deducted first, and where expiration dates are the same, Credits granted earlier are deducted first. Whether the Credits from a given purchase have been used is determined based on this deduction order; if any portion of the Credits from a purchase has been deducted, that purchase is deemed used.
- Unused Purchased Credits are forfeited upon expiration of their validity period, and no refund is provided on the basis of such expiration.
Article 4 (Notice Regarding Withdrawal of Subscription)
- The Service is a digital service for which Credits are granted, and use becomes immediately available, upon payment; provision of the Service accordingly begins at the moment the User completes payment.
- By proceeding with payment, the User acknowledges the foregoing and the commencement of provision of the Service, and agrees that the right of withdrawal under Article 17 of the Act on the Consumer Protection in Electronic Commerce and other applicable law may be restricted.
- Notwithstanding the foregoing, where applicable law recognizes a User's right to a refund (such as where provision of the Service has not commenced, or where the User is unable to normally use the Service due to the Company's fault), such law shall prevail.
- To protect Users, the Company provides a full refund where Credits have not been used within 14 days, under Article 3(3). This is a policy voluntarily provided by the Company irrespective of whether a right of withdrawal is recognized under applicable law.
- Where Paddle processes a refund separately from this Policy, whether under its own policy or applicable law, the Company may recover the Credits granted in connection with the relevant payment.
Article 5 (Exceptions Where a Refund Is Available)
In the following cases, a refund may be provided within the scope permitted by applicable law and Company policy:
- Where, due to a material Service outage attributable to the Company, the User was unable to normally use the Credits paid for;
- Where a payment error, such as a duplicate or mistaken charge, occurs regardless of the User's express intent; or
