Article 1 (Purpose)

These Terms of Service (“Terms”) govern the rights and obligations between Out of Set Inc. (“Company”) and users regarding the use of the “Airy” platform (“Platform”) operated by the Company and the individual services provided through the Platform (“Services”).

Article 2 (Definitions)

  1. Platform: The entire service delivery environment operated by the Company under the name “Airy,” including its website, applications, APIs, SDKs, and any other means of access.
  2. Service: An individual product or feature provided by the Company through the Platform. The Company may add, modify, or discontinue Services.
  3. Service-Specific Terms: Separate terms applicable to a particular Service (including fees, feature-specific limitations, eligibility requirements, and prohibited conduct), which apply together with these Terms.
  4. User: A person who agrees to these Terms and any applicable Service-Specific Terms and uses a Service.

Article 3 (Effect and Amendment of Terms)

  1. A User is deemed to have agreed to these Terms upon registering for an account or beginning to use a Service.
  2. Where Service-Specific Terms, or individual notices regarding pricing plans or features, differ from these Terms, the Service-Specific Terms shall prevail with respect to matters concerning that Service. Matters not addressed in the Service-Specific Terms shall be governed by these Terms.
  3. Where the Company amends these Terms, it will provide notice at least 7 days before the effective date (or at least 30 days before the effective date for amendments unfavorable to Users). If a User continues to use a Service after the amended Terms take effect, the User is deemed to have agreed to the amended Terms. A User who does not agree may discontinue use before the effective date. This Article applies mutatis mutandis to amendments of Service-Specific Terms.

Article 4 (Eligibility and Accounts)

  1. Users of Services directed at consumers must be at least 14 years of age; minors require the consent of a legal guardian. Eligibility requirements for Services directed at businesses may be separately set out in the applicable Service-Specific Terms.
  2. Users must register with accurate information, and are responsible for any issues arising from false information.
  3. Users are responsible for managing their own account and authentication credentials (including passwords and API keys) and may not share them with others. Any action taken through a User’s account or credentials is deemed to be the act of that User.
  4. If a User becomes aware that their account or credentials have been used without authorization, they must notify the Company immediately. The Company may temporarily restrict use where necessary for security reasons.

Article 5 (Provision and Modification of Services)

  1. The Company may add, modify, or discontinue all or part of a Service as needed for business or technical reasons, and will provide advance notice of material changes.
  2. Beta or trial Services may change in accuracy or availability without prior notice.
  3. Upon the launch of a new Service, the Company will publish the Service-Specific Terms applicable to that Service in advance.
